Summarised principles of Trespasser's right on the ground of settled possession and Injunction in relation thereto;

I) A trespasser is not entitled to an injunction against the true owner.
ii) A trespasser in settled possession is entitled to defend his possession even against the true owner unless he is evicted by due process of law.
iii) Settled possession means, a trespasser's possession must be effective, undisturbed, and to the knowledge of the true owner and for a sufficiently long period to show acquiescence by the true owner.
iv) What is sufficient long period depends upon the facts of each case.

On 11.01.2021 Supreme Court held that Developer cannot compel the apartment buyers to be bound by the one-sided contractual terms contained in the Apartment Buyer‘s Agreement as the incorporation of such one-sided and unreasonable clauses in the Apartment Buyer‘s Agreement constitutes an unfair trade practice under Section 2(1)(r) of the Consumer Protection Act, 2019.
